These Terms of Service ("Terms") govern your access to and use of the website, services, and programs offered by Nicke Nmuio. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

1. Service Description

Nicke Nmuio provides wellness coaching and educational services focused on exercise, nutrition, and lifestyle optimization. Our services include:

• Personalized wellness consultations and assessments
• Customized exercise program design
• Nutritional guidance and meal planning support
• Lifestyle coaching and habit formation strategies
• Educational resources and materials

All services are provided remotely unless otherwise agreed upon in writing. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.

2. Medical Disclaimer and Limitations

You acknowledge and agree that:

• Nicke Nmuio is not a medical doctor, registered dietitian, or licensed healthcare provider
• Our services do not constitute medical advice, diagnosis, or treatment
• Our recommendations are educational in nature and should not replace professional medical care
• You should consult with your physician before beginning any exercise program or dietary changes
• If you experience any pain, discomfort, or adverse symptoms, you should stop immediately and seek medical attention
• We do not guarantee any specific results or outcomes from following our recommendations
• Individual results will vary based on numerous factors including genetics, adherence, and individual circumstances

3. Eligibility

By using our services, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from receiving our services under applicable law
• You will provide accurate and complete information when requested
• You will promptly inform us of any health conditions that may affect your participation

4. Payment and Refund Policy

Payment Terms:

• All fees are quoted in Euros (€) and must be paid in advance unless otherwise agreed
• Payment is accepted via bank transfer or other methods specified on our website
• Prices are subject to change with notice; existing clients are grandfathered at their agreed rates

Refund Policy:

• Baseline Diagnostics (€99): Refundable within 14 days if no services have been rendered
• Performance Accelerator (€399): 50% refundable within 30 days of program start if less than 25% of program completed
• Elite Transformation (€849): Pro-rata refund available within 45 days based on services rendered
• No refunds for completed consultations or delivered program materials
• Refunds are processed within 14 business days of approval

5. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, videos, program materials, and educational resources, is the property of Nicke Nmuio and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our materials for personal, non-commercial purposes only. You may not:

• Copy, reproduce, distribute, or publicly display any content without written permission
• Modify, adapt, or create derivative works from our materials
• Use our content for commercial purposes or resale
• Remove any copyright or proprietary notices from materials
• Share program materials with non-paying third parties

6. User Conduct

When using our services, you agree not to:

• Provide false, misleading, or incomplete information
• Attempt to access areas of the website or services without authorization

• Testimonials are only published with your explicit written consent

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• Nicke Nmuio shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the specific service giving rise to the claim
• We are not responsible for any injuries, health complications, or adverse effects resulting from following our recommendations
• We do not guarantee uninterrupted or error-free access to our services
• We are not liable for any loss or damage caused by events beyond our reasonable control

9. Indemnification

You agree to indemnify, defend, and hold harmless Nicke Nmuio, his employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of our services, your violation of these Terms, or your violation of any rights of another.

10. Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination:

• Your right to use our services immediately ceases
• Any outstanding fees remain due and payable
• Provisions of these Terms that by their nature should survive termination shall remain in effect

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Almere, Netherlands.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Material changes will be communicated via email or website notice at least 30 days before taking effect. Your continued use of our services after any changes constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between you and Nicke Nmuio regarding our services and supersede all prior agreements, understandings, and representations.
